Illinois divorce appealed; what next?
I was recently divorced in Illinois and my ex husband filed an appeal. He is on his own no lawyer . He claims that he was not informed of when our court dates would be and wants the judgement vacated. I KNOW he was informed of the date at the same time we my lawyer and I were and I am thinking it is in the court records. Has anyone been through this? What should I expect? Will the appellate court look at the circuit court records or is that something we have to bring to their attention? Any information or personal experience is greatly appreciated

Illinois divorce - assets division in short marriage?
in a marriage lasting less than 2 years, with no kids, how are assets divided? is it split down the middle or do both people go out with what they came in with? also, does the wife keep the marriage and engagement rings, or return them?

Illinois Divorce Law: Can you get divorced without having to go through a custody battle?
My brother has a 3 year old son. His wife and him are currently separated. He wants to file for divorce. Does he have to do the custody battle and divorce at the same time, or are they two separate entities? They live in Illinois.There will for sure be a custody battle. So do the divorce and battle happen at the same time or are they 2 different things?

Illinois Divorce Laws Help?
So I have been married a year and I want a divorce, we have a one year old, I am in Illinois, he is in Virginia. We were married in Illinois. I recently relocated here. In Virginia you have to be separated a year if you have kids in order to get a divorce. We have already worked out an agreement as far as custody and Child support and we have no assets to split. However, I am having trouble finding Illinois Laws, Do I still have to be separated a year to get divorced?, Do I need a lawyer?, Can I go to the courthouse and just filed for Divorce?, How much does that cost? Please only knowledgeable people respond, Thanks.

Illinois Divorce Laws?
My aunt is stuck in an unhappy marriage. Her husband hasn't worked in over 5 years. He injured his back at work. They have been married for 6 years and own a house. The thing is, my aunts name is on the house, not his. He refused to put his name on the house. However the state of Illinois law states that if a person goes through a divorce their possessions are split in half. My question is because my uncle has been out of work for so long leaving all the bills to be taken care of by my aunt is there anyway around this? My aunt is stuck in an unhappy marriage because he emotionally abuses her and isn't the man she thought she married.

Does an arrest and conviction matter in an Illinois divorce?
A few years back,I caught the wife cheating big time.But here in Illlinois both lawyers I talked to told me I was screwed.Here in Illlinois it's " No fault" state,and she'd still get half,no matter how many partners she had.So we re still legally married but pretty much seperated.Well,the other night she got pulled over and blew a .181.over double the limit,plus she had a pinch hitter and less than 2.5 grams of weed.Will this arrest change the fianancials of a divorce settlement?

If my ex husband signed paperwork stating that he is responsible to pay 28 percent of wages for child support, when does that take effect? Am I still entitled to half of his wages until the divorce is final? Ugh, I despise the drama....

Who can elaborate on the Illinois divorce and custody laws?
OK, I'm close to petitioning my wife for Illinois divorce but I'm concerned about a couple things. We have 3 young kids and I'm very close to them.According to my attorney since my wife was a stay home mom she is " primary caregiver" and I stand about zero chance of getting physical custody of any. Only if I could prove she's a really bad mom like a crack addict do I have a chance.That said, she is bipolar and gets overwhelmed kind of easy with all 3 kids so I don't think it is best if she has all 3. I know the 2 boys would rather live with me. So the question is if she won't settle to fight and spend lots of money and put the kids through hell or to just admit this is how it is and focus on transitioning the kids....Anyway, I thought I would see if any of you have anecdotal evidence or other advice that doesn't cost $3 a minute. My attorney is considered best in town but no matter what happens to me he won't lose any sleep over it.
