Divorce/separation/child custody father's rights?
i was married in 2000, separated in 2004, moved on to other relationship, as did my husband, he unfortunatley got his girlfriend pregnant, they now have a 2 1 2 year old son, i have filed for divorce 3 times and never followed through with the proceedings, as well as my husband refusing to sign the papers, we were very young when we got married and simply had issues to sort out before we moved on with our relationship, i.e. responsibility, sowing wild oats, that sort of thing, i still love my husband very much as he does me, we are still the very best of friends and talk everyday, he also bought a house with his girlfriend, she put $30k down and he has made the payments since then, he is the bread winner of the family, the cook, the cleaner, the nurturer, and his son prefers him to his mother, i guess i have several questions, this one is kind of stupid i guess, aren't we still married since we never got a divorce and he has never claimed her as his wife, even though there's property involved? what are his odds of winning sole physical custody of his son? the mother is not fit, she is 22, he is 28, for him it's like raising 2 children, she just hangs around because she's got it made, she doesn't pay bills, clean, cook or take care of the baby. the only bridge for us to cross to be back together weighs about 38 pounds and his name is Dalton, my husband will not leave him or even have 50 50 custody, he knows she is unfit, he will stay with her forever to keep him safe, any help or advice would be greatly appreciated, i live in alabama
