Hi. I very much hope that if I get married to my foreign girlfriend, all will work out for a permanently happy future. We have had a great track record together since being together, however I am always poised in life for something nasty to happen. So I like to be prepared. I have a mortgage on a house which I have paid into for just over a year. It's a 35 year mortgage. House value 90k. Mortgage obviously in my name. Now let's say it stays in my name, and mostly I'm the one paying it off each month once married. What could be the various options if she wanted a divorce after say, 3 or 5 years? And with kids or no kids?Unfortunately from what I've read, there is no such thing as a pre nup in the UK. Thanks I would hope it wouldn't happen Thank you all for your intial advice. I haven't asked my father yet, but if I could put the house in his name and just pay him the mortgage would this be a solution? Or leave it in a conditional will for my dad? Or sister? In the event I die before either of them? Since it is unlikely I will have kids before I am married, in which I can name them in a will.

my ex husband bought me out house after 18 yrs marriage last year. i was a full time mother and now we shared 50 50 custody of the kids age 14 and 10. I finally got a job after had applied 8 jobs last year and i have been working for 23 25 hours week. my all income goes to our apartment rent. i asked my ex to help our living expenses because he makes 10 times more. he keeps telling me that he gave me a settlement for our living expenses. i have neither alimony nor child support. i will drain my bank account divorce settlement within next 2 years. does divorce settlement supposed that includes a child support ?

I got my divorce settlement monies today after 4 years of fight in the hight court. For some reason, I feel quity about it. I feel as if I have stolen someone else's hard earned money.My ex earns 5 times more than I do and has assets of worth atleast 1m , and had cheated on me which led to our divorce 4 years ago. He had settled the financial matters and agreed to pay me 240,000 after 4 years of marriage. I always had my average job which I still do, and a very comfortable life. I have some small assets of my own as well.He obviously never paid what he had consented to , and I had to drag this matters in the courts for last 4 years and finally I got paid my debt.I still feel I am trying to justify why I should be paid this money. But, somewhere I feel that this was his money that he worked very hard to earn.What do you say?
What jurisdiction does Spanish law have regarding divorce settlement of two non-EU non residents of Spain?
I own a house in Spain but her name is not on the deeds. She has embargoed the property claiming to the spanish court I owe her money, which I do not. This has been overturned. But what right did a spanish court have over a non EU person to make a judgement in the first place? We weren't married in Spain and the spanish don't know what settlement I gave her as it's not the business of the spanish The ex lied to the court to obtain money but this was eventually overruled. However as the judgement was flawed in law, my lawyer says it now has to go back to court to enable me to defend the original action. But if the action was flawed and deemed full of mistakes, and thrown out of court, what is there to defend? Surely my ex has to make a new case against me at the very least? I should add I knew nothing about any of this as she sent all the legal notices to the wrong address deliberately, which is how the embargo happened. I am not domiciled in Spain either. And neither is she. I am american.Neither of us are spanish residents. I have got a lawyer on this, but they just seem to be taking money?
Question about child insurance in divorce settlement?
My wife and I are doing an uncontested, no fault divorce. We are filling out the paperwork and turning it into the lawyer.There is something on there that asks how we will split up some kind of non insurance type of payment. Supposedly my wife says that doesn't include co pays, but only extraordinary circumstances such as an emergency room visit? Is that correct?And if so. I make 30,000 a year and my wife makes 60,000 a year. I have no insurance and she does. So is it fair for me to suggest then that I pay 33 % of that " non insurance" cost and she pay %77?And does $325 dollars a month sound like a fair amount for me to pay to her each month. The child will be living with her. Please do not answer, " see a lawyer" or " I'm not sure, need more info" . Just give it your best shot and answer with what you thinks best
Why does the husband generally come out worse from a divorce settlement?
But when you see a bad divorce like that the woman always somehow gets most of the stuff the couple owns rather than just half even if there are no kids and also he has to pay her half of his earnings for like 10 years or something after the divorce, this is crazy Why can't they simply share everything then whoever looks after the kids gets extra money over time from the other parent? Why so much unfairness?

Here's what he did He told his soon to be ex wife to make a list containing all their property including community property , and to split it into 2 lists at her discretion.The catch? He got to choose which list of stuff to take, not she. They never even called a lawyer.?

In our part of the world, a man pays the dowry that was agreed at the time of marriage and expenses for children. This if very fair and woman deserve them specially if the divorce is for the fault of the man. Similarly, the woman may not get anything at all if a case of infidelity is established against her. But I never understood the justification for US court decisions where the men were paying million of dollars to their divorced wives. I have read news of many accomplished celebrity sportsman, politician, actor to loose almost everything that they have earned in all their lives to woman their divorced wives who were just lucky to marry them for some period of time and haven t earned any part of the wealth. This cannot be the law of CIVILIZED system. If a US court ever ruled a wife to pay million to the divorced husband for her being infidel I am sure many marriages are broken for women s infidelity too ? How about the gays in the US? Do their marriage and divorce laws also require similar payment of millions?
