If a wife files a divorce petition what happens if the husband does not respond?
if she files it on unreasonable behaviour by the husband and his family ?what would happen if the husband did not respond ?as he has not done anything wrong and that the reason why his wife left him because he had a mental break down only because he became ill ????say if he went to court and argued about the unreasonable behaviour and also had proof that he has done no such thing then what would happen??

Where does my divorce petition stand?
In reply to the divorce petition filed by me on grounds of cruelty and for the custody of my child after my wife left me along with my daughter, my wife filed a maintenance petition u s.125 wherein she also levelled several charges against me and my family members which include Dowry harassment, Mental harrassment, Alcohlic abuse and assault by me , confinement etc. She also filed for inter state transfer of the divorce petition from Maharasthra to Andhrapradesh where she stays with her parents. Now in her second attendance in the Court she submitted a stay petition obtained from the Supreme Court. At the same time she stated before the Judge that she wanted to come back and stay with me. My wife submitted a written statement in the Court that she is ready to stay with me and that she will withdraw all cases filed by her against me. Bud the Judge told her that he had no objection to her staying with her husband but advised her to settle the Supreme Court matter first and then submit anything in this Court and refused to accept her written statement. I DONT KNOW WHY HE SAID AND DID THAT? Now the situation is that as my wife had come all the way from her home state alongwith my 22 months daughter, I could not control my emotions and brought them back home. It is more than 2 weeks now but my wife seems totally non repentant about the charges she levelled. Further she is all the same as she was earlier and doesn't seem to care less about me or my old mother who is living separately with my unmarried brother as she is too scared to come and join me. In the meantime, i failed to attend on the date on which i was summoned by the family court where my wife had filed the maintenance petition. My lawyer tells me that its no big deal as my wife is already staying with me. Can somebody kindly tell me where my Divorce Petition stands. Does it stand to get cancelled by default just becuase my wife and child are staying with me now without my expressed objection? I would like to withdraw my petition only subject to certain conditions set out before the Court to which my wife is refusing outrightly just because she has sensed my weakness for my daughter.My lawyer says that she was helpless as she also sensed my uncontrolled affection for my daughter in the court premises. But now I have realised I would be in a very helpless state even for the welfare of my daughter if I continue with my wife in this kind of situation. If I foresake my daughter she has got her mother and maternal grandparents to take care of her but who will take of my mother in her last days when she needs me the most Kindly advise as myemotions are confusing me and my wife seems to take advantage of that. I also want to know that can the family court on the basis of charges mentioned in the maintenance petition filed by my wife convert them into a FIR or aggravate the matter for me and what could be the consequences of my non attendance in response to the summons issued by the Family Court at my wife's native place? My lawyer told me the she has spoken to my wife's lawyer who told her that anyway the judge was on leave on the date of my hearing so it was likely to be adjourned. Does is work that way actually?

divorce in any court, but again a week back he asked the same lawyer to fwd. the draft to his mail id and he sent that to his sis. asking her to check, when i asked if he is trying for divorce n if so we can go mutually, Initially he said that he cant live with me n as i always wanted divorce ,so he wants divorce and later after blaming me like his life was ruined because he got married to me and blah blah n blah he said he never filed for divorce nor neither he will do it.i really dont understand if he got the divorce petition drafted why is he not filinf in court and why is he saying that he will never file.is there any sort of legal trick in this, can any of the lawyers answer me...please.P.s I really never wanted to have divorce, but in the past when we really had a big fight i told him that if he dont want to live with me its ok i will leave, so now as i said that in past he is saying i alway wanted divorce from him, and he is saying iam finally getting what i want, i tiold me that i dont want divorce but he was not convinced and he said things will happen as i wanted, what does this mean

My wife has put a divorce petition in India and I am currently out of the country on a project for 6 months.I have hired a lawyer and sign a vakalatnama. I am afraid the lawyer might negotiate anything on my behalf in my absence if the other party offers him some money.Should I give a power of attorney to my father or someone so only they can make important decisions in my absence?
