I really need advice/insight from anyone familiar with california divorce process.?
i appolagise in advance for the length of this post. i married my " husband" in 2006 and found out last december he was still married to his ex. there is strong evidence the bigamy was done on purpose. he has been very deceptive about many things. that said, i told him that behavior was unexeptable, and if he wanted me to remain in the relationship he needed to straiten out his stuff. he said he wanted to divorce his ex and then remarry me.he retained a lawyer in cal and paid an agreed fee , about 1,100, as well as filing fee, to draw up all paperwork and file all papers throughout divorce process. he paid in advance b 4 process was started. husband and i live in oregon his ex lives in cal so she is pettioner and lawyer is technicly hers eventhough husband found him and paid for everything. husband is unrepresented.on april 9 his ex did file the divorce one can see case on public web site. it is regular divorce with children. husband and ex have a 15 year old daughter who lives 100 % of time with mother.husband was served by first class mail on april 14 he suposidly sent a signed agknowlegment of service and his response to ex's lawyer in early may.he said in his response he expressed unhappyness with her request that any travel w daughter be limited to 3 counties in sothern cal. he said after lawyer recieved response his ex came to lawyer's office and agreeed that there not be any restrictins on travel so long as ex,daughter,and husband were in agreement about any proposed trips. husband said everything was fine and lawyer told him divorce should be final in october no problem. that was in june.i periodicly view website and noticed since the initial filing in april nothing else had been submitted to court. no proof of service filed even though lawyer must have it, husband's response sent to lawyer was never filed either nothing filed by husband at all so i called court clerk and was told case is not progressing because nothing submitted also she said filing proof of servace was needed to start the mandatory 6 month clock ticking, and case can't proceed without it. she also said it was unuasual for lawyer to have proof of service and not file it. in clerk's opinion something was wrong untypical about the way case is progressing. i am wondering if lawyers sometimes wait until all paper work is done and then submit everything to court at once for approval, in which case things may be fine, or am i being conned again? any imput is more than welcome,and greatly needed thanx eve p.s. asking husband what's going on would be ideal, but won't work in this situation

How to proceed with a california divorce when spouse is living in another country with our kid born in US?
Ok, I fully understand I need to talk to an attorney, which I will do for sure. But I want to get a honest opinion on my situation. No intention of being rude but I don't want vague advices or funny comments. Anything else would be greatly appreciated.Here is my situation.Me and my spouse were married in a foreign country. We moved to US now settled in CA on visa and later applied for permanent residency.After few years, we decided to file for divorce based on fundamental differences and consulted a paralegal attorney for a mutually agreed divorce. We were ready to file the divorce and then my spouse had to go back to our birth country with our US born child for a 2 month period. Now my spouse is not willing to come back and I have to guess its because my spouse does not want a divorce. Our green cards arrived after she went out of country and it will expire if my spouse doesn't come back to US soon. I don't want to screw up my spouse's life in the name of divorce and I'm willing to provide alimony and or child support as applicable by law. My spouse did not work after marriage H4 visa till now but I'm willing to part with our savings as per the law or give her alimony. I also understand my spouse loves our kid same as I do and hence I will agree to a fair child custody deal. I want to be resonably fair but at the same time I also don't want to be plundered by my spouse in the name of divorce.What are my options now? If I hire an attorney how this is going end? 1. Can I still file and get a divorce in this situation?2. Isn't illegal for my spouse to keep our US born child in a foreign country?3. Can my spouse contest the divorce from the foreign country or does she have to come to california to contest?I reiterate, We tried reconcilliation for couple of years now and it didn't work out. At this time there is not other option other than to file divorce.Thanks.

after the other had defaulted and the notice of default has been entered by the court clerk, how long does the judgment take to signed and enter by the judge?

California divorce law?
I live in California & I'm going through a divorce. My attorney says that based on CA law that since I filed for the divorce it would behoove me to " offer" my soon to be ex 1 2 of the community portion of my retirement. Other people I've talked to don't know what I'm talking about. They said they didn't have to " offer" their soon to be ex anything. We were only married 5 years & don't own a house or property. I make more money than him I my attorney said that I need to make him a nice offer in attemtps to avoid court. Once in court the court will split my life insurance, 401K retirement, bank accts in half for the portion of our marriage.Why didn't my friends have to offer anything? Is this something new to California? What is it???

California Divorce question....What do I need to do?!?
So I filed for divorce back in may of 2007...I had an attorney, and went though the mediations, child custody and money and financials and only had to sign off the final paper...Suddenly I am told I am not divorced yet and my ex claims she already signed it...Although she failed to pay her attorney...Could this be why? How can I get this settled fast?

I was married in california for 1 year 5 months, then my wife left and moved in with relatives. A year and a half later, Im going to file for a divorce. Can she go after me for support? If so, I have heard that you have to support her for one day for every two you were together. Would I go my the date she left or the date I filed for the divorce?
